MINE HILL, NJ – Hazmat storage violations often result in bodily injury or even death. Otherwise, the best one can hope for is a penalty. Fiabila USA is a nail polish manufacturer is facing $109,500 in penalties for improper storage of chemicals known for fire, explosion, and health hazards. Earlier this year, the improper storage solution resulted in a leakage of flammable liquids the plant had stored on-site, exposing temporary and permanent employees to the hazards.
There are a number of factors that resulted in the company being cited, along with two staffing agencies that place employees at Fiabila. The penalty against these two agencies totals $30,000, for failure to train their employees in proper hazmat-handling procedures.
Situations at the manufacturing plant included fire, explosion, and health and safety hazards. Kris Hoffman, OSHA area director at the Parsippany office, cites the Occupational Safety and Health Act of 1970, which requires that employers provide a safe workspace for employees. The two staffing agencies are at fault for their negligence in ensuring a safe workspace for the workers they placed at Fiabila USA.
Hazmat Storage Violations: Comply or Contest
Fiabila’s website highlights their “focus on safety” and claims that all “Fiabila sites meet local and international safety assessments,” in spite of the charges from the Occupational Health and Safety Administration. All three companies have fifteen working days from their receipt of their citations to comply or contest the allegations, or request an informal conference with Mr. Hoffman to review any abatement steps the companies have taken, which might result in an informal settlement agreement and omit the need for litigation.
